Terms of service

These terms of service (terms) govern access and use of the services and web sites of Zasqr (the "Services"), and any other information, text, graphics, photos, images or other materials uploaded, downloaded or appearing on the services (collectively referred to as "content"). Access to and use of the services is conditioned to the acceptance and compliance with these conditions. By accessing or using the services you agree that you will be bound by these conditions.

Basic conditions

You are responsible for the use of the services, for any content you post in services and the resulting consequences. The content that you submit, post or show can be viewed by other users of the services through third party web sites, applications and services. You should only provide content that you really want to share with other people in these terms.

The user may only make use of these services if you agree to a binding contract with Zasqr as well as to receive such services according to the laws of Spain. The user may only make use of such services in accordance with these conditions to any law, policy or regulation applicable to be local, State, national or international.

Services Zasqr provides are always evolving and the form and nature of those services may eventually change without prior notice. In addition, Zasqr may stop (permanently or temporarily) provide these services (partially or wholly) to the user and/or users with or without notice. Zasqr reserves the right to limit the use or storage in its sole discretion at any time without prior notice.

The services may include advertisements, which may be referred to the contents or services, questions through such services, or other information. The type and extent of advertising Zasqr on the services are subject to change. Considering that Zasqr ensures access and use the services by the user; the user must accept Zasqr and third-party suppliers or partners to Zasqr overpower advertising in the services or in connection with the content or information from the services it is posted by the user or others already.

Privacy

Any information that the user provides to Zasqr is subject to our privacy policy, which governs our collection and use of information. The user should understand that through the use of the services you consent to the collection and use (as set out in the privacy policy) of this information, including the transfer of this information at the national level and/or other countries for storage, processing and use by Zasqr. As part of our delivery services, we perhaps need to deliver certain communications, such as announcements, administrative messages and services. These communications are considered part of the services and the account in Zasqr, and the user could not be able opt not to receive them.

Passwords

You are responsible for safeguarding the password that you use to access the services and for any activities or actions under your password. We encourage you to use "strong" passwords (passwords that use a combination of uppercase and lowercase letters, numbers and symbols) to your account. Zasqr cannot and will not be responsible for any loss or damage caused by your failure to comply with the above requirements.

Content of services

The responsibility of all content, published or disseminated privately, rests with the author of such content. Zasqr does not monitor or control the content posted via these "services" and is not responsible for such content. Any use or reliance of any such content or materials published through this service, or obtained by the user through these services is by account and risk of the user.

Zasqr does not approve, supports, represents or guarantee the completeness, truthfulness, accuracy or reliability of any content or through services release nor endorses any opinions expressed through such services. The user understands that these services can appear in content offensive, harmful, inaccurate or otherwise inappropriate, or in some cases, tickets badly identified or misleading. Zasqr shall not be liable, under any circumstances and in any way, any content, including, but not limited to, any errors or omissions in the content, loss or damage of any kind occurred as a result of the use of any content posted, Envoy, e-mail transmitted or made available via the services or broadcast in other media.

Rights of the user

The user reserves the rights of any content submitted, posted or submitted through the services. The user is responsible for the use of these services, of any content and consequences of the same, including the use of your content by other users and third parties associated. The user understands that its content can be broadcast by our partners and if the user has not the right to submit such content for such use, the liability would be of the user. Zasqr will not be responsible nor you shall be deemed as the use of the content of the user by Zasqr according to these conditions. The user represents and warrants that it has all rights, powers and authority necessary to grant the rights granted herein to any content that the user sends.

Zasqr provides the user personal license, with coverage worldwide, free and without exclusivity for the use of this software offered by Zasqr as part of the services. This license is only intended to allow the user to use and enjoy the benefits of the services provided by Zasqr in the way stipulated in these conditions.

Zasqr rights

All right, title or interest in and to the services (excluding content provided by users) are and will remain exclusive property of Zasqr and its licensors. The services are protected by copyright, trademark and other laws of other countries both Spain. These conditions not granted right never one to the user to use the name, trademark, logo, domain or another distinctive feature of the mark. Any response, comment or suggestion that the user provides with respect to Zasqr or to such services is completely voluntary and Zasqr is free to use such information, comments or suggestions deemed appropriate without any obligation towards the user.

Restrictions on the content and use of services

We reserve the right at any time (but we will not have an obligation) remove or refuse to distribute any content on the service and to delete users or reclaim usernames. We also reserve the right to access, read, preserve, and make public any information as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process or Government request, (ii) do comply with the terms, including investigation of potential violations thereof, (iii) detect, prevent, or otherwise lead to fraud, security problems or technical, (iv) respond requests for user support, or (v) protect the rights, property or safety of Zasqr, its users and the public.

The user is not authorized to perform any of the following actions when accessing or using the services: (I) access, unduly manipulate or use non-public areas of the services, the computer systems of Zasqr, you technical systems for the implementation of Zasqr, (II) providers review, scan or test the vulnerability of any system, or connect, transfer or overcome any security measure; (III) access, investigate or attempt to access or research services by any method (automatic or not) other than through the interfaces that Zasqr has prepared and published (and only pursuant to the terms and conditions above) unless you have been specifically authorized to do so in an additional agreement with Zasqr; (IV) forging any TCP/IP header or any part of the header in any e-mail or publication information, or the use of the service in any way to send the altered source identifying information, misleading or false; or (V) interfere, or deteriorate (or try to do), the access of any user, server, or network, including but not limited to, sending out viruses, overload, overwhelm, sending junk mail, or bombard with e-mail services, or using a script for the creation of content in such a way that interferes or generate an undue services burden.

Copyright policy

Zasqr respects the intellectual property of others and expects users of the services to do the same. Zasqr will respond to notices of alleged copyright infringement that comply with applicable law and be provided to Zasqr properly. If the user believe that your content has been copied in a way that constitutes copyright violation, Zasqr urges that the following information be provided: (I) physical or electronic signature of copyright owner or the person authorized to act on its behalf. (II) identification of the property who owns the author claiming to have been raped. (III) identification of the property claiming to have been raped or be the subject of the violation of copyrights and which must be eliminated or prohibit access to which should be disabled, and any relevant information to allow Zasqr the location of the material. (IV) the user information, including address, phone number and email address; (V) the Declaration of the user who believes in good faith that the material according to the way which has been exposed, is not authorized by the copyright owner, his representative or the law; and (VI) a statement confirming that the information in the notification is accurate and, under penalty of perjury, that the user is authorized to act on behalf of the owner of copyright.

Zasqr be reserve the right to remove allegedly offending content without prior notice and in its sole discretion. Under certain circumstances, Zasqr may also close a user's account if this is a repeat infringer.

Services are available "AS IS"

Access to and use of the services or any content is at your own risk. You understand and agree that the service is provide "As is" and "As available". Without prejudice to the above, ZASQR and their partners refuse any guarantee, express or implied, of merchantability, fitness for any purpose or non-infringement. We do not offer any guarantee and accept responsibility for the integrity, accuracy, availability, opportunity, security or reliability of the service or any content. Zasqr is not responsible for any damage to your computer system, loss of data, or any other damages resulting from your access to or use of the services, or any content. You also agree that Zasqr has no responsibility or liability for the deletion or not storage or transmission of the content and other communications maintained by the services. We do not offer any guarantee that services meet your needs or that are available uninterrupted, secure or error-free. No advice or information, whether oral or written, obtained from Zasqr or through the services, create any warranty not expressly herein.

The services may contain links to web sites or third party resources. The user knows and accepts that Zasqr is not responsible for (I) the availability or accuracy of such websites or external resources, or (II) the content, products or services of these or available on such web sites or external resources. Links to these websites or external resources do not imply support from Zasqr to such sites or resources, or the content, products or services available from such sites or resources. The user knows and assumes all responsibility and risk from the use of any of these web sites or external resources.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZASQR and ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOST PROFITS , DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS OR USE OR INABILITY TO ACCESS OR USE THE SERVICE, (ii) ANY CONTENT OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE, INCLUDING WITHOUT LIMITATION, ANY ACT OF DEFAMATION, OFFENSE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTY, (iii) ANY CONTENT OBTAINED FROM THE SERVICES AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER ZASQR ARE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF A REMEDY SET FORTH HEREIN IS TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, which exposed limitations above, may not be applicable.

Assignment and Severability clause

The failure by Zasqr to enforce any right or provision of these terms shall not be deemed to be transfer of such right or provision. In the event that any provision of these terms and conditions is invalid or not enforceable, the remaining provisions of these terms will remain in full force and effect.

Applicable law and competent jurisdiction

These terms and conditions or any other action related to them shall be governed by the Spanish laws without taking into account or application clauses of conflict of laws of the State or country of residence of the user. Any claim, legal proceeding or litigation arising in connection with these services, legal proceedings or litigation arising in connection with the services will take place only in the courts of Barcelona. You agree that jurisdiction and venue in such courts and waive any objection as to the inconvenience of Forum.

Entire agreement and agreement between the parties

These terms, the rules for Zasqr and our privacy policy, constitute the complete and exclusive agreement between Zasqr and you in relation to the services (excluding those services for which you have an agreement separately with Zasqr that is explicitly in addition or instead of these terms), and the present conditions supersede and replace any prior agreements between you on Zasqr and services. Apart from the members of the Group of companies of which Zasqr is the company mother, no other person or company will be beneficiary of these terms as third party.

Zasqr privacy policy

This privacy policy describes the policies of Zasqr and procedures on the collection, use and disclosure of your information. Zasqr receives the information through various web sites, APIs, applications, services and third parties ("services"). For example, if send us information by using Zasqr from our web site, add a Zasqr widget to your web site, or accessing Zasqr from an application like Zasqr for iPhone, Zasqr for Android. By using any of our services, you accept explicitly the collection, transfer, handling, storage, disclosure and other uses of your information as described in this privacy policy, regardless of the country of residence and regardless of the country in which such information is read by third parties.

Collection and use of information

Collected under registration information: when the user is logged in a Zasqr account, you will be asked a limited amount of information, such as name, username, password and email address and it is possible that in future should be asked more. The name and username is provided, will be displayed publicly in the user's profile.

Additional information: Through the account settings, the user can provide Zasqr information to make public on the profile page, and a short biography, information about the location or an image. It is also possible to provide information that will serve to better adapt the service of Zasqr to the user, such as facilitating the date of birth, sex or country of residence to help the user to find similar users in Zasqr. Zasqr can also use contact to send own offers or information of third parties or provide information about services. If you decide at any time that no longer wish to receive such information or communications from Zasqr, you can follow the instructions for unsubscribing found in the message or on our sites. If the user makes contact by e-mail, Zasqr can save the contact information and correspondence, and may use the email address and any other information that the user provide Zasqr in the message to answer him. It is completely optional to provide the additional information described in this section.

Registration data: Our servers automatically record information ("registration data") created by your use of the services. Third party services: Zasqr uses a variety of services hosted by third parties to help provide our services, hosting our various blogs and wikis, and to help us understand the use of our services as Google Analytics. Exchange and dissemination of information

Your consent: The reading of a Zasqr code represents your consent explicit share the information contained in your registration of user (or part of such information) with the person, company, entity that has previously generated code Zasqr. Do this to allow you to use the full functionality of our services and to receive information, contribute your opinion, participate in a sweepstakes, confirm your attendance to an event and other associated functions to a determining code Zasqr.

Service providers: Third parties contracted by Zasqr are responsible for carrying out certain functions and provide services to Zasqr. Modify personal information

You can also permanently remove your account from Zasqr. If you follow the instructions specified on our website, your account will be deactivated and then deleted. When your account is deactivated, it will not be available and visible in Zasqr.com. For a maximum of 30 days, it is possible to restore your account if it was illegally or accidentally disabled. Zasqr policy concerning children

Our services are not directed to children under 14 years.
